This Agreement is entered into by and between ACA K9 Enterprises, LLC d/b/a Acadia Canine Academy (referred to herein as “ACA”) and:

The Owner represents that he/she is the lawful owner of the dog and has the sole right to enter into this Agreement. ACA will work daily with Owner’s dog on training items. Board and train focuses on assisting the Owner with various training areas which may include any one or more of the following: (a) beginner and puppy foundation training; (b) leash pressure; (c) obedience levels 1, 2 and 3; (d) off-leash training; (d) behavior modification; (e ) dog/human aggression; (f) working through fear and anxiety; (g) personal protection foundation to be discussed first; (h) eliminating bad habits and behaviors. ACA will discuss with the Owner and evaluate the Owner’s dog to assess which training areas will be needed and worked on. The Owner acknowledges that there are no guarantees as to what is accomplished in training since there are so many factors for each dog when it comes to training including the length of time the dog is in the board and train program, whether the dog has any prior training, etc.

 

In addition to training, dogs will be provided exercise and socialization, weather permitting. ACA personalizes each board and train stay depending on the dog. Depending on the needs of the dog, Owner understands that the dog will enjoy individual attention and, if permitted, Pack - oriented experiences as well.

 

Upon the scheduled pickup of the dog, the Owner will be provided with a one-on-one private training session to ensure that the Owner is educated on the training put into their dog and so the Owner goes home with the proper techniques and knowledge to continue the dog’s training success.

Schedule & Payment

Under the above selected option, the Owner will be dropping the dog off & picking up on:

Any changes in drop-off times and/or pickup times will incur a mandatory $125.00 charge due to the fact that all too many times it involves contacting other clients scheduled that particular day and attempting to have them alter their itinerary to accommodate the changes you have requested. This also involves rearranging our own operations on that particular day. There is a ripple effect that affects others and us which causes stress on all parties.

Payment for board and train services is required upon drop off. Owner acknowledges that a non -refundable $600.00 deposit per dog is required for the reservation and is due upon signing this Agreement. Owner further acknowledges that the remaining balance must be paid, in full, when the dog is dropped off. In addition, the Owner acknowledges that for each day that the dog remains at ACA past the pickup date shown above, will be an additional $120.00 per day charge due when the dog is picked up. All board and train prices are subject to New York State sales tax. ACA accepts cash, check, money order, Zelle, or Venmo. The Owner acknowledges that there are no refunds. Owner agrees to pay in full for any and all services rendered by the Company and that remaining balances for board and train services must be paid at the time of drop off. Owner understands that ACA does not give refunds for services rendered or services purchased and not used. The prices agreed to herein do not include recommended training equipment such as special collars, leashes, e-collars, etc. Should such equipment be recommended, the Owner can purchase them directly from ACA should the Owner choose to, Dog Food & Other Items for the dog also. Owner acknowledges that the dog’s food and any needed medication for the duration of the stay is the Owner’s responsibility and should be dropped off with the dog. ACA does not wish to change your dog’s diet and cannot possibly stock the wide array of dog foods available on the market. The Owner acknowledges that he/she may also drop off toys, a dog bed or blankets from home to assist in making the dog as comfortable as possible. However, the Owner acknowledges that there is a chance these items can be damaged or lost. As such, the Owner agrees that ACA will not be held responsible or liable for any lost, stolen or damaged personal property belonging to Owner or his or her dog.

Socialization. Owner acknowledges and agrees that the Owner’s dog is permitted to interact and play with other dogs and with ACA staff members. Owner further acknowledges and agrees that his/her dog will, in most cases, be socialized with other dogs while at ACA. Like children on a playground, dogs can get scratches, nicks or bites as they interact and play with other dogs. Owner acknowledges that animals are unpredictable and there is possibility of injury to his or her dog, or another dog during such controlled socialized activities. In fact, while the dogs are carefully monitored by ACA staff, to prevent injury, it is still possible that during the course of normal canine play, the Owner’s dog may get injured. The Owner, however, agrees that the benefits of socialization outweigh the risks and accepts the risk. The Owner understands that socialization services are included in the board and train program and that ACA may, at its sole discretion, remove Owner’s dog from the socialization services if it is necessary to protect the health and well-being of the Owner’s dog, other dogs or staff of ACA without providing the Owner with a prorated refund of any kind.

Owner’s Release & Indemnification to ACA. Owner agrees to release, indemnify, and hold harmless ACA from any and all manner of damages, claims, loss, liabilities, costs or expenses, including reasonable attorney’s fees and related costs, arising out of or related to ACA’s services, except which may arise from the gross negligence or intentional and willful misconduct of ACA, including, without limitation, (i) any inaccuracy in any statement made by the Owner or information provided by the Owner to ACA; (ii) the Owner’s dog, including but not limited to destruction of property, dog bites, injury, and transmission of disease, and (iii) any action by the Owner which is in breach of the terms and conditions of this agreement. ACA reserves the right to immediately change his or her dog’s boarding or doggie daycare schedule if ACA believes it is necessary to protect the health and well-being of the Owner’s dog, other dogs or ACA staff.

Vaccinations & Documentation. Owner is aware that kennel cough (a/k/a “Bordetella”) is a common problem in facilities where there are groups of dogs that intermingle. All of the dogs at ACA are vaccinated against Bordetella, however, there are a number of viruses that can cause the cough and no vaccination will prevent all cases. Owner confirms his/her dog is current on all vaccinations as required by ACA and understands that complete documentation confirming such vaccination requirements including, but not limited to, Bordetella, rabies and distemper vaccinations shall be required prior to entry at the ACA facility. There will be no exceptions regarding the aforementioned required vaccinations.

Flea & Tick Preventative. Owner confirms his/her dog is free of fleas, ticks, worms and other insects and parasites and that his/her dog is on a flea and tick preventative. ACA reserves the right to reschedule the board and train if it determines, at its sole discretion, that the dog is not free of fleas, ticks, worms or other parasites since this poses significant risks to other dogs and ACA staff.

HEALTH POLICY

We require all dog owners to follow this protocol:

1. Completed a series of standard vaccines and current boosters. 
2. Up-to-date rabies vaccine. 
3. Recent deworming. 
4. Ongoing monthly flea and tick prevention. Documentation required.
5. Vaccine for bordetella bacterium and regular boosters. 
6. Recent vet visit for (a) complete physical, (b) skin check-up (infectious staph, sarcoptic mange, demodectic mange, mites, lice, ringworm, fleas, ticks, etc.) and (c) fecal lab test to rule out intestinal challenges like giardia, coccidia, and other contagious parasites. Complete documentation and vet signature required.

Notice! Dogs in heat (Estrus) cannot attend board & train courses for a minimum of 21 days. No exceptions. 

​

Emergency Care of Dog. ACA will make every attempt to call and contact the Owner and Emergency Contact (as previously provided by the Owner) in the event of an emergency situation. The Owner authorizes ACA to take actions they deem reasonably necessary to ensure the health, well-being, and safety of the Owner’s dog and to take reasonable action to resolve any medical problems that may arise while the dog is in its care. The Owner agrees to assume full financial responsibility for any and all expenses incurred as a result of ACA’s actions. The Owner understands that ACA staff is expected to make a reasonable attempt to contact the Owner and/or the emergency contact (listed below) before incurring such expenses, that they may need to incur such expenses if they can't reach me, and that an emergency could arise where it would not be feasible for them to contact me before the expense is incurred. In all scenarios, the Owner agrees to take full financial responsibility of the expenses incurred on its dog’s behalf.

ACA’s Limit of Liability. It is expressly agreed by Owner and ACA that ACA’s liability shall not exceed the lesser of the current value of the dog of the same breed or the sum of $500.00, whichever is less.

Dog’s Picture, Name and Other Likeness. Owner acknowledges that pictures and videos may be taken of the Owner’s dog for media, marketing and advertising purposes. Owner agrees to allow ACA to use the Owner’s dog’s name and any images, in any form or format, for use, at any time, in any form of media, marketing, print or advertising without providing the Owner prior notice or fees for same.

Training Techniques Used by ACA. By participating in our board and train program, Owner acknowledges and fully understands that ACA will employ training tools and techniques that are used to train and modify the behavior of dogs. Furthermore, Owner is aware that dog training at Acadia Canine Academy can include training tools such as e-collars (only in rare instances, this will be implemented with Owner's prior knowledge & written consent). Owner engages ACA to provide services for his/her dog as is deemed necessary in the sole discretion of ACA.

Natural Disaster/Emergency Policy. In the event of a natural disaster including, but not limited to tornado, flooding, earthquake, etc., or other emergencies that makes the ACA facility unusable (i.e., fire, flooding), the Owner understands it is his/her responsibility to pick up the dog (or make arrangements for pick up) in a timely manner and in accordance with any mandatory evacuations, etc. The Owner understands that ACA will do everything reasonably possible to secure the safety of the dog during a natural disaster and the Owner agrees to indemnify, release, and hold ACA harmless of any and all liability related to any natural disaster of any sort.

Governing Law. This Agreement is governed by the laws of the State of New York without regard to conflicts of law principles. ACA and the Owner agree that all actions or proceedings arising directly, indirectly or otherwise in connection with, out of, or related to or from this Agreement shall be litigated only in courts located in Ulster County, New York.

​

Severability. If any provision of this Agreement is determined to be unenforceable, such provision will be deemed severed and the remaining provisions of this Agreement will continue in full force and effect. ACA will be deemed to have accepted this Agreement, without execution, upon the acceptance of a reservation or payment for services to be provided hereunder or the commencement of the services.

Pickup and Release of Dogs. There will be no pickup of dogs outside normal business hours or any time prior to the contractually scheduled release/return date without prior approval by ACA. I agree that ACA is not obligated to release my dog to me or a duly authorized representative until ACA is paid in full either by cash, Cashier’s Check, or money order for any accrued unpaid charges. I agree that I relinquish any property rights to my dog until I have met my outstanding financial obligation to ACA. In the event that outstanding charges are not paid within 30 days, I do not contest the fact that the dog in question becomes the legal property of ACA upon by default.

Updates/Progress Reports of Dogs and Video/Photos Policy. We have come to realize at ACA that the ever-increasing demands of clients for updates and progress reports have become all too cumbersome to accommodate and that such demands have infringed on our ability to give adequate attention to our training obligations to our clients and their dogs. It is therefore that we invoke policy that no update/progress reports will be made in the first 7 days of any Board & Train Course a dog is signed up in. This is being employed in order for fairness to the clients and their dogs. As for Videos, Photos and even FaceTime as was requested by one client, we can no longer accommodate these requests as a courtesy as it has become all too work-intensive and diverts us from our primary purpose which is to train your dog.

OWNER FULLY UNDERSTANDS AND AGREES THAT IF OWNER ABANDONS HIS/HER DOG AT ACA FACILITY, OWNER MAY BE UNABLE TO RETRIEVE POSSESSION OF HIS/HER DOG AND WILL HAVE NO RECOURSE AGAINST ANY ACA EMPLOYEE, OFFICER, OWNER AFFILIATE OR AGENT. (30 DAYS IS CONSIDERED ABANDONMENT)

Owner agrees to all terms and conditions of this agreement, which shall be binding between Owner and ACA.

 

PET OWNER AGREES AND ACKNOWLEDGES THE ABOVE:

DEPOSIT FEE: $600 REQUIRED FOR ALL TRAINING COURSES

The Balance must be paid in full when you drop off your dog. Space is limited to a maximum of 4 dogs boarding and training in our home, not at the kennel, to allow us to focus on your dog and his/her individual needs.
